New Developments Regarding Association Health Plans (AHPs)

A U.S. District Judge has ruled that allowing individuals and small businesses to group together in order to purchase health insurance violates both ObamaCare and ERISA.
This ruling is the result of a lawsuit filed by 11 states. The judge ruled that the Administration did not have the authority the change ERISA rules.
It is unclear now whether AHPs will be allowed to continue providing coverage. The judge asked the DOL to indicate whether any part of the rule would still be valid.
While this decision could be appealed and make its way through the judicial system, we will continue to update you as developments become available.
